ANNOUNCEMENT FOR TENDER Notice is hereby given that sealed tenders will be received for IE project “Airfield Pavement Slurry Seal” #J21-00-144, at Edgeley, North Dakota. Bids will be received by the Edgeley Municipal Airport Authority, at the office of Interstate Engineering, 1903 12th Ave SW, Jamestown, North Dakota 58402, until 2:00 p.m. (CT) on Thursday, March 24, 2022, then said office will all bids properly submitted will be publicly opened and read aloud. Offers may be mailed or delivered to Interstate Engineering, PO Box 2035, 1903 12th Ave SW, Jamestown, ND 58402-2035. The project will include the following approximate works: Airfield Marking, Crack Sealing, Major Crack Repair, Airfield Pavement Grout Sealing. Each tender will be submitted on the basis of cash payment for the work. It will be enclosed in a sealed envelope addressed to the above mentioned Airport Authority, 508 1st Ave, Edgeley, ND 58433, and must be designated that the tender is for “Airfield Pavement Slurry Seal”. The bid must be accompanied by a bond from the bidder in a separate envelope in the amount of five percent (5%) of the total amount of the bid, executed by the bidder as principal and by a surety company licensed to do business in North Dakota. If Principal’s offer is accepted by OWNER and Contract is awarded, Principal, within ten (10) days of notice of award, shall be bound to execute and perform a Contract in accordance with the terms of Principal’s offer and all OWNER’s requirements and conditions. The tender and the tender bond must be executed by a principal. The bid bond must identify the name and title of the persons who signed the bid bond. Signatures by anyone other than a President, Vice President or CEO must be accompanied by sufficient evidence (duly signed meeting minutes, resolution, power of attorney, etc.) to indicate that the signatory has the authority to bind the business or organization. A contractor’s bond, as required by North Dakota Century Code Section 48 01.2-10, must be included with the signed contract documents. The bid security must comply with Section 48 01.2-05 of the North Dakota Century Code. All bidders must be licensed for the highest amount of their bids as required by North Dakota Century Code Section 43 07 07 and a copy of license or renewal certificate thereof must be attached to the required bid security envelope. No tender will be read or considered unless it fully complies with the above bonding and licensing provisions, and any deficient tender submitted will be closed and returned immediately to the tenderer. Edgeley Municipal Airport Authority reserves the right to reject any or all offers submitted and to waive any formality in any offer and to retain all offers for a period not to exceed thirty (30) days and to withhold three lowest bids. and bid guarantees for a period not exceeding sixty (60) days from the date of opening of bids. The successful bidder will be required to comply with all applicable federal labor laws, including the United States Department of Labor minimum wage rate rulings, which are contained in the advertised specifications. Bidders and sub-bidders are required to comply with Title 29, Code of Federal Regulations (1518, 36 FR 7340) promulgated by the United States Secretary of Labor pursuant to Section 107 of the Contractual Labor Hours Act and safety standards, (82 Stat. 96) not requiring any worker or mechanic to work in an environment or in working conditions that are unsanitary, dangerous or dangerous to their health and safety. The Owner, pursuant to Title VI of the Civil Rights Act of 1964, 78 Stat. 252, (42 USC 2000D and SEQ) and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination of Department of Transportation Federal Government-Assisted Programs Published Under of this act, hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this announcement, minority business enterprises will have full opportunity to submit in response to this invitation and will not be victimized discrimination on the basis of race, color, religion, sex or national origin in consideration of a reward. A contractor with 50 or more employees who can obtain a contract of $50,000 or more and subcontractors with 50 or more employees who can obtain a subcontract of $50,000 or more will be required to maintain a affirmative action whose standards are contained in the advertised specifications. (41 CFR 60-1.40). The Contractor will be required to submit certification of non-separate facilities from all subcontractors for subcontracts exceeding $10,000.00. Contractors are subject to the Equal Employment Opportunity Affirmative Action Requirement (Executive Order 11246, as amended), the provisions of which are contained in the Advertised Specifications. Subcontractors are subject to the provisions of 49 CFR Part 30, Denial of Public Works Contracts to Suppliers of Goods and Services from Countries that Deny Market Access to U.S. Subcontractors. The Bidder must submit information about the Disadvantaged Business Enterprise to the Owner. The award of the contract is subject to compliance with the requirements of the DBE. The target for Disadvantaged Business Enterprise participation is 3.00%, Race Conscious, of the cost of the contract. The improvement work must begin on a date to be specified by the Airport Authority, notice of which will be given to the successful tenderer ten (10) days before the start of construction.
